    Abstract Patients who allege negligent treatment by their psychiatrists can sue to be compensated for the harms they experience. But what if the harms result from a criminal act committed by the patient that the patient claims the psychiatrist should have prevented? A long-standing common law rule bars plaintiffs from being compensated for harms caused by their own wrongdoing. The Supreme Court of Pennsylvania recently considered the scope of this rule in the case of a psychiatric patient convicted of murder. Even when the rule is upheld, various exceptions may exist, and there is pressure to do away with an absolute bar on recovery of damages.

    Abstract An aging workforce is forcing employers to deal with the challenge of workers who may develop cognitive impairments. Federal law prohibits workplace discrimination based on age and disability and sets limits on permissible policies. Mandatory retirement, with only a few exceptions, has been eliminated, and age-related screening likely violates antidiscrimination statutes. Employers are permitted to target assessments at workers who show signs of impairment. Applying that rule in a fashion that is fair to employees, and protective of the interests of employers and the public, is the difficult, but vital, task ahead.

    Abstract Violence by patients is common in psychiatric facilities. Under federal law, however, employers are charged with taking steps to protect worker safety. A recent case from a psychiatric hospital in Colorado illustrates how the Occupational Safety and Health Act can be invoked to remedy deficiencies in workplace safety. Following an anonymous complaint by an employee, an onsite investigation revealed multiple lapses, ranging from inadequate staffing to an antiquated emergency system, which had led to frequent injuries among staff as a result of patient assault. After a court hearing, the hospital's challenge to a remediation plan was rejected, creating a precedent for improving safety at other facilities.

    Abstract Guardianships allow court-appointed guardians to make decisions on behalf of persons who are incapable of caring for themselves. With their authority frequently extending over both the personal and the financial affairs of a ward, guardians sometimes abuse their extensive powers. Misuse of funds, excessive fees, and neglect of the ward's needs all have been seen in guardianship cases. As awareness of this problem has grown, innovative approaches have been developed to prevent and detect abuses, including mandatory certification, centralized audits, and visits to persons under guardianship to assess their status. Funding such efforts, however, remains a challenge.

    Abstract People with mental illnesses are markedly overrepresented in U.S. jails and prisons. Although a variety of factors account for this overrepresentation, punitive actions by prosecutors and judges in response to behaviors caused by mental illness play an important role. A recent Maryland case illustrates how such actions can occur, with excessive charges filed against a woman whose behavior was clearly related to a mental health crisis and the imposition of a disproportionate sentence. Educating prosecutors, defense attorneys, and judges about the nature and consequences of mental illnesses is an essential step toward mitigating the punitive approach of the current U.S. criminal legal system.
