    Abstract Social compensation law is spread over many, and often obscure, individual laws. It only accounts for a very small part of the social budget and is therefore not a favourite of journalists, politicians and scientists. It only takes the spotlight in very rare cases, such as when catastrophic floods or street riots are in the news.However, social compensation law actually raises elemental issues of governmental liability which are connected to private and public liability law. What distinguishes it from state liability law, which is generally dealt with individually? Why does the state undertake the task of providing for compensation of damages? Why are catastrophes and riots only dealt with ad hoc and by means of individual acts?These questions are answered in three steps: Firstly, by assessing the current state of affairs, which includes fringe areas and international requirements, also from a historical and comparative perspective; secondly, by systematisation, which includes normative ideas on the duty to provide compensation of damages; and thirdly, by reflections on how to organise existing compensation situations, recognise new ones and combine all these by means of codification

    Abstract Social insurance thrives, among other things, on the involvement of employers. This cooperation has remained important to the present day. In fact, in some Western European countries, employers are duty bound more than before, for example in cases of work accidents or continued payments of wages in the event of sickness. In the USSR, "employers" were in a different position from the outset: their companies were state-owned and therefore, administrative state duties in the field of social security could be delegated to them at any time. The purpose of these conference proceedings is to investigate how the role of the Russian employer in the social security system has changed compared to the situation during the USSR era. Which legal liability is ascribed to employers today? Does the enforcement of employees' entitlements to social benefits depend on the fulfilment of employers' obligations in the fields of social insurance and occupational safety law? The answer to these questions contributes fundamentally to the understanding of Russian social security law. An analysis of the main aspects of the topic is given from a Russian point of view and subsequently summarised and expanded upon from a German point of view

    Abstract Funktionierende Gesundheitssysteme zählen zu den wichtigsten sozialstaatlichen Errungenschaften. Weil sie weitgehend national organisiert werden, sind Einblicke in ausländische Systeme aufschlussreich: Sie erlauben vor dem Hintergrund der Erfahrungen mit dem eigenen System einen Vergleich von Aufgabenstellungen, institutionellen Ausprägungen und normativen Leitideen. Der Band erschließt deutschen Lesern die in Polen geführten Diskussionen um die Bedeutung verfassungsrechtlicher Vorgaben für die Gesundheitsversorgung, verbunden mit einem ausführlichen Überblick über das bestehende polnische Versorgungssystem.     Abstract Der Band beginnt mit einer Einführung, die das Verhältnis zwischen Sozialrechtsdogmatik und Sozialrechtsvergleich beleuchtet, die Begriffe klärt und zeigt, wie sich dogmatische Forschung der rechtsvergleichenden Methode bedienen und wie der Rechtsvergleich für die Dogmatik fruchtbar gemacht werden kann. Die folgenden Beiträge sind in vier Teile gegliedert, von denen drei die grundlegenden Sozialrechtsverhältnisse und der letzte gesellschaftliche Hintergründe des Sozialrechts beleuchten. Behandelt werden das Vorsorgeverhältnis (Rainer Pitschas, Ingwer Ebsen und Peter A. Köhler), das Leistungsverhältnis in Förderungs- und Hilfesystemen (Karl-Jürgen Bieback, Gerhard Igl und Bernd Schulte), das Leistungserbringungsverhältnis (Maximilian Fuchs, Peter Trenk-Hinterberger und Andreas Hänlein) sowie die Rolle der Familie im Sozialrecht (Eberhard Eichenhofer, Alexander Graser und Ursula Köbl).
