    Abstract The organizational requirements for an error-free and effective care of patients within a large-scale hospital are high: despite all efforts to improve the process quality and the establishment of risk management systems and reporting systems, there exists the general impression that the processes and communicative challenges are still - in particular with regard to the grown influence of economic factor - prone to error: in case of doubt to the harm of the patients. The topic, which has a medical and organizational sociological, an economic and not least a (criminal-)legal dimension, was the subject of the traditional annual meeting of the Göttingen Institute for Criminal Science in July 2016

    Abstract In times of rapidly changing social worlds and an ever more fragile controllability of the law, international legal comparison obtains increasing relevance. Frequently, similar or even identical questions and problems must be answered and solved in different legal communities, but there is rarely a single answer or solution. For a decade, the Faculty of Law of the University of Göttingen and the Yonsei Law School in Seoul (Republic of Korea) have engaged in continuous dialogue about both current and fundamental questions of legal reform. In October 2018, the fifth German-Korean Symposium took place. The lectures and presentations covered highly relevant aspects of public environmental law, insolvency proceeding, law of criminal sanctions and law of the constitution of the criminal courts as well as computer crime, including historic and philosophical foundations of the law.     Abstract In the event of the loss of the ability to give consent and thus the possibility of legally validating one's own will, the law regularly provides for a mandatory third-party representation for the patient. However, their design can be influenced preventively, for which purpose those affected are given three options. These options are: patient's decree, health Power of Attorney, guardianship order. The patient's decree makes content related specifications as to which medical interventions are accepted or not accepted in which illnesses. Health Power of Attorney authorizes another person to make the necessary treatment decisions on behalf of the patient and guardianship order relates solely to the case of a possible guardianship appointment by the guardianship court. The written form of the advance directives forms an objective basis for mutual control of future decision-makers in the event of questions of interpretation. Absolute certainty that the current will of the patient corresponds to the future and that it is reliably determined and implemented in the decision-making situation is not possible. Nevertheless, the task is to come as close as possible to this ideal image in clinical reality.

    Abstract In case of patients who are incapable of decisionmaking, familiy members are only authorised for representative decisionmaking (in accordance with the presumed will of the patient) if they can submit a (written) health care disposition or have been appointed as guardians by court. In urgent cases, the court can also enforce the patient's right to self-determination itself by ruling (§ 1908i and § 1846 BGB = German Civil Code). With effect from 01.01.2023, spouses will by law (automatically) become representatives in all matters of health care. However, this new regulation contains a number of conditions and reservations as well as it raises some questions about implementation in clinical practice.

    Abstract Reports on medical billing frauds, "premiums" of hospitals (for the referral of a patient) as well as the "medical marketing" arouse increasing attention in times of dwindling financial resources within the socially insured healthcare system and the worry for spreading "rationing". Out of consideration for the partly remarkably high financial damages the call for a harsh punishment suggests itself, but the criminal law is always late and, above all, isnt capable of compensating the intangible loss of trust. Therefore, the search for instruments of an effective prevention of corruption deserves far more notice, but consequently the question of the real criminal events and of the possible "adjusting screws" for preventive interventions as well. The articles in this volume, which come from the recent (organized on 8 July 2011) annual conference of the Institute of Criminal Law and Justice in Göttingen, present the latest findings available so far. They may provide the interested public with an insight, that is respectably and not clouded by the drive of mass-media scandalisation, into the extent and appearances of corrupt behaviour in the healthcare system and may give the experts suggestions for productive further discussions and innovative problem solvings
